A notary also called a Notary Public in common is a qualified and experienced lawyer nominated, on the recommendation of the tribunals under the provisions of act LII of the Notaries of 1952, by the state or central authorities, who may oath and declare a person as affidavits and contracts before him to be authentic, with the label appointed and stamped on it.

Steps for becoming Notary Public

First: You first must have a degree in LLB to be a notary. In order to obtain an L.LB degree the applicant must take an admission exam by the law departments of different universities in India or the independent law institutes. One of the most important ways to get into the legal profession is with the CLAT (Common Law Admission Test). CLAT is held each year to accept students into the five year Integrated B.A.L.B Degree Course. The topics asked in CLAT are broadly Logical Reasoning, Elementary Mathematics, Legal Aptitude, Current Affairs and English.

Second: Any graduate must undertake a compulsory internship as required by the rules of institutions once they have graduated and after effective completion.

Third: After completing his internship, he/she is required to become a practitioner and to acquire the requisite experience to register for notary licenses as an advocate in just about any state bar council, governed by the Advocates Act of 1961.

Fourth: Following at least 10 years of advocacy (seven years in the Scheduled Caste/Schedule Tribe or other groups backward, and women candidates), one is qualified for appointment as a notary. If not a lawyer, the applicant should be a member of Indian Legal Service or get a central or state administration role requiring specific legal know-how or an office in the Advocate-General, Department of Judge, or the Armed Forces.

Fifth: The applicant must present a request to the relevant authority of the relevant government, in form of remembrance, as stipulated in the rules. Where a notary is approved, the applicant shall be issued and gave in the State or Central Gazette a certificated profession. His name is registered in the notary’s register held by the State.
